Privacy Policy

Last Updated: January 15, 2025

At Maxdrivewave, we take your privacy seriously. This policy explains how we collect, use, and protect your personal information when you work with us on retirement planning and pension consultation services.

We're based in Bangkok and operate under Thailand's Personal Data Protection Act (PDPA). But more than legal compliance, we believe in treating your financial information with the respect and security it deserves.

Information We Collect

The nature of retirement planning means we need to understand your financial situation. Here's what we typically collect and why we need it.

Personal Details

  • Your name, date of birth, and contact information so we can communicate with you properly
  • National identification or passport number as required by Thai financial regulations
  • Employment history and current occupation to understand your pension eligibility
  • Marital status and dependents because this affects retirement planning strategies

Financial Information

  • Current income, savings, and investment accounts to assess your retirement readiness
  • Existing pension plans or retirement funds you've already established
  • Debts and financial obligations that impact your long-term planning
  • Tax information relevant to pension contributions and retirement income
  • Property ownership and other assets that form part of your retirement strategy

Information You Give Us Directly

When you fill out our consultation forms, send emails, or talk with our advisors, you're providing information voluntarily. We also collect data when you attend our workshops or download resources from our website.

Sometimes clients share information during phone calls or video meetings. We keep notes from these conversations to provide better service and maintain continuity across different advisors on our team.

Technical Data

Our website collects basic technical information like your IP address, browser type, and how you navigate our site. This helps us improve the user experience and identify technical issues. We use standard analytics tools that many businesses rely on.

How We Use Your Information

Everything we collect serves a specific purpose in helping you plan for retirement. We don't use your data for unrelated marketing or sell it to third parties.

Purpose Why It Matters
Retirement Planning Analysis We need your financial details to create personalized retirement strategies that actually work for your situation
Pension Optimization Understanding your current pension arrangements helps us identify opportunities to improve your retirement income
Regulatory Compliance Thai financial regulations require us to verify client identity and maintain certain records
Service Improvement Analyzing how clients use our services helps us develop better tools and resources
Communication We need your contact details to schedule meetings, send documents, and provide ongoing support

What we don't do: We never use your financial information for automated decision-making without human review. Every recommendation comes from an actual advisor who understands your unique circumstances.

Sharing Your Information

We keep your information confidential, but there are specific situations where we need to share limited data with trusted partners.

Financial Institutions

When we help you set up pension plans or retirement accounts, we share relevant information with banks, insurance companies, or investment firms. This only happens with your explicit consent, and we only share what's necessary to complete the transaction.

Legal Requirements

Thai law sometimes requires us to disclose information to government agencies. This includes tax authorities, financial regulators, or in response to court orders. We'll inform you when legally permitted to do so.

Service Providers

We work with carefully selected third parties who help us run our business. This includes cloud storage providers, email services, and document management systems. These companies are bound by strict confidentiality agreements and can only use your data as we direct them.

We never sell your personal information to marketing companies, data brokers, or anyone else. Your financial details stay between you, us, and the specific institutions you choose to work with.

Your Rights Under Thai Law

Thailand's Personal Data Protection Act gives you significant control over your information. Here's what you can do and how to exercise these rights.

  1. Access Your Data: You can request a copy of all personal information we hold about you. We'll provide this within 30 days in a readable format.
  2. Correct Inaccuracies: If any information we have is wrong or outdated, let us know and we'll fix it promptly. Accurate data is essential for good financial planning anyway.
  3. Request Deletion: You can ask us to delete your information, though we may need to keep some records to comply with Thai financial regulations. We'll explain what we must retain and why.
  4. Object to Processing: If you disagree with how we're using your data, you can object. We'll either stop or explain why we need to continue based on legal obligations.
  5. Data Portability: You can request your information in a structured, commonly used format to transfer to another service provider.
  6. Withdraw Consent: For any processing based on your consent, you can withdraw that consent at any time. This won't affect any processing we did before you withdrew consent.
  7. Restrict Processing: In certain situations, you can ask us to limit how we use your data while we resolve any concerns you have.

To exercise any of these rights, email us at info@maxdrivewave.com or visit our office. We'll verify your identity and respond within the timeframes required by law.

How We Protect Your Information

Financial data requires serious security. We've built multiple layers of protection into how we handle your information.

Technical Safeguards

  • All data transmission uses encryption protocols that meet banking industry standards
  • Our servers are located in secure facilities with restricted physical access
  • We maintain regular backups stored in geographically separate locations
  • Access to client data requires multi-factor authentication for all staff members
  • We conduct regular security audits and vulnerability assessments

Organizational Measures

Every employee signs confidentiality agreements and receives training on data protection. Access to client information is limited to team members who need it for their specific role in serving you.

We maintain detailed access logs so we know exactly who viewed what information and when. Our advisors work from secure devices with encrypted storage and automatic screen locks.

Document Security

Physical documents are stored in locked filing cabinets within our office at Fortune Town. When we need to dispose of paper records, we use cross-cut shredding services. Digital documents are encrypted both in storage and during transmission.

No security system is completely foolproof. If we ever experience a data breach that affects your information, we'll notify you within 72 hours as required by Thai law and take immediate steps to minimize any harm.

How Long We Keep Your Information

We don't keep your data indefinitely. Our retention periods balance your privacy rights with legal requirements and practical business needs.

Active Client Records

While you're an active client, we maintain complete records to provide continuous service and track your retirement planning progress over time. This ongoing relationship means we need historical data to make informed recommendations.

After Service Ends

Thai financial regulations require us to keep certain records for five years after our professional relationship ends. This includes documentation of the advice we provided and the basis for our recommendations.

After this mandatory retention period, we securely delete your information unless you've given us specific permission to keep it longer. Some clients prefer we maintain their records in case they want to return for future consultations.

Tax and Legal Documents

Documents related to tax filings or legal matters may need to be kept for seven years per Thai Revenue Department requirements. We'll clearly mark these records and explain the retention period when we collect them.

International Data Transfers

We primarily store and process your information within Thailand. However, some of our technology providers operate servers in other countries.

Where Your Data Might Go

Our email system and cloud storage providers may process data in Singapore or other Southeast Asian locations with strong data protection laws. We've verified that these jurisdictions provide adequate protection under Thai PDPA standards.

We use contracts with these providers that require them to maintain security standards equivalent to what Thai law requires. Your data receives the same protection regardless of which server physically stores it.

Your Control Over Transfers

If you prefer that your data stays exclusively within Thailand, let us know. We can accommodate this request, though it may limit some features of our digital service platform.

Cookies and Website Tracking

Our website uses cookies to function properly and improve your experience. Here's what we track and why.

Essential Cookies

Some cookies are necessary for our website to work. These remember your login session, keep your consultation form filled out if you navigate away, and maintain security settings. You can't disable these without breaking the site's functionality.

Analytics Cookies

We track which pages get visited, how long people stay, and where they come from. This helps us understand which resources are most valuable and where people get confused. The data is aggregated and anonymized so we can't identify individual visitors.

Managing Your Preferences

Your browser settings give you control over cookies. Most browsers let you block or delete them, though this might affect how our site works. We don't use advertising cookies or track you across other websites.

Changes to This Policy

We review and update this privacy policy periodically to reflect changes in our practices or legal requirements. The date at the top shows when we last made updates.

If we make significant changes that affect how we use your existing information, we'll notify you directly by email and give you a chance to review the new policy before it takes effect. Minor clarifications or additions might not warrant individual notification, but we'll always maintain the current version on our website.

For active clients, we'll discuss any major privacy changes during your regular consultation meetings. This gives you an opportunity to ask questions and understand exactly how the changes might impact you.
